In a partial judgment in family proceedings, Borken District Court ordered the applicant to give the respondent an account of his end assets as of 16 February 2000. The disclosure must be made in a signed, clearly organized inventory identifying the assets and liabilities individually by type and quantity. The costs decision was reserved for the final judgment. The judgment was declared provisionally enforceable; the applicant could avert enforcement by providing security of DM 1,000 unless the respondent first provided security in the same amount.

Der Antragsteller wird verurteilt, der Antragsgegnerin Auskunft über den Bestand seines Endvermögens per 16.02.2000 durch Übergabe eines von ihm zu unterschreibenden Vermögensverzeichnisses, in dem die einzelnen Vermögensgegenstände und Verbindlichkeiten nach Art und Anzahl genau bezeichnet - übersichtlich zusammengestellt sind, zu erteilen.
Die Kostenentscheidung bleibt dem Schlußurteil vorbehalten.
Das Urteil ist vorläufig vollstreckbar.
Der Antragsteller kann die Vollstreckung der Gegenseite durch Sicherheitsleistung in Höhe von 1.000,00 DM abwenden, wenn nicht die Antragsgegnerin vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
