In this first-instance civil judgment, the Borken Local Court ordered the defendant to pay the plaintiff EUR 2,500 in non-pecuniary damages and EUR 272.87 in pre-litigation legal fees, each with interest at five percentage points above the base rate from 10 November 2011. Tenor

Die Beklagte wird verurteilt, an den Kläger ein Schmerzensgeld in Höhe von 2.500,00 Euro zu zahlen sowie vorgerichtliche Rechtsanwaltskosten in Höhe von 272,87 Euro, jeweils nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 10.11.2011.

Es wird festgestellt, dass die Beklagte verpflichtet ist, dem Kläger alle materiellen Schäden, die im anlässlich der Operation vom 15.05.2008 entstanden sind oder noch entstehen, zu ersetzen, soweit die Ansprüche nicht auf Sozialversicherungsträger oder Dritte übergegangen sind.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des zu vollstreckenden Betrages vorläufig vollstreckbar.
