In this civil judgment, the Borken District Court partly maintained its default judgment of 6 February 2013. The defendant remains liable for EUR 3,850.86 with interest from 15 November 2012 and a further EUR 446.13 with interest from 28 November 2012, in each case at five percentage points above the base rate. The court set aside the default judgment and dismissed the claim for the remainder. It also ordered the defendant to bear the further costs of the proceedings.

Das Versäumnisurteil vom 06.02.2013 wird in Höhe von 3.850,86 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 15.11.2012 sowie weitere 446,13 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 28.11.2012 aufrecht erhalten. Im Übrigen wird es aufgehoben und die Klage abgewiesen.
Die Beklagte trägt auch die weiteren Kosten des Rechtsstreits.
Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar. Die Vollstreckung aus dem Versäumnisurteil darf nur gegen Leistung der Sicherheit fortgesetzt werden.
