In this first-instance civil case, the Gronau District Court ordered the defendant to pay the plaintiff €43.50, together with interest at five percentage points above the base rate from 15 September 2004. The court dismissed the claim insofar as it exceeded that award. It allocated three quarters of the litigation costs to the plaintiff and one quarter to the defendant. The judgment is provisionally enforceable. The court dispensed with setting out the facts under § 313a(1) ZPO.

Tenor

Die Beklagte wird verurteilt, an den Kläger 43,50 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 15.09.2004 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger zu 3/4, der Beklagte zu 1/4.

Das Urteil ist vorläufig vollstreckbar.

Auf die Darstellung eines Tatbestandes wird gemäß § 313 a Abs. 1 ZPO verzichtet.
