Tenor

Der Beklagte wird verurteilt, die im Objekt H-Str. ###, 48599 Gronau, im 2. Obergeschoss gelegene Wohnung, Wohnungsnr. ##, bestehend aus 2 Zimmern, Küche, Bad inkl. Kellerraum geräumt an den Kläger herauszugeben.

Der Beklagte wird verurteilt, vorgerichtliche Rechtsanwaltskosten in Höhe von 413,64 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz ab dem 14.07.2018 zu zahlen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar. Der Beklagte kann die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 4.500,00 € abwenden, wenn nicht der Kläger vor der Vollstreckung bezüglich der Herausgabe der Wohnung Sicherheit in Höhe von 4.500,00 € leistet.
