The Düsseldorf Local Court ruled on the defendants’ counterclaim and ordered the plaintiff to fit the penthouse apartment with devices for recording heating-energy consumption. The apartment was described as comprising two rooms, a kitchen, hallway, and bathroom. hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 3. November 1986

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Auf die Widerklage wird der Kläger verurteilt,

die "Penthouse-Wohnung", gelegen in X,

X-straße , X. Obergeschoss, bestehend aus

zwei Zimmern, Küche, Diele und Bad, mit Ausstattungen

zur Erfassung des Verbrauchs von Heizenergie zu versehen.

Das Urteil ist vorläufig vollstreckbar, wenn die Beklagte

zu 2. Sicherheit durch selbstschuldnerische, unbedingte

und unbefristete Bürgschaft einer deutschen Bank oder

Sparkasse über 3.500,- - DM leistet.
