In this first-instance civil judgment, the Düsseldorf Local Court partially allowed the plaintiff's payment claim against the defendant. It ordered payment of DM 2,006 with 4% interest from 3 April 1986, less the DM 1,506 paid on 14 May 1986, and dismissed the remainder. The plaintiff was assigned 15% of the litigation costs and all costs of obtaining the expert opinions; the defendant was assigned the remaining 85% of litigation costs. Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 14. Juli 1988

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Der Beklagte wird verurteilt, an den Kläger 2.006,- DM nebst

4 % Zinsen seit dem 03.04.1986 abzüglich am 14.05.1986

gezahlter 1.506,- DM zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger zu 15/100, der

Beklagte zu 85/100, jedoch mit Ausnahme der Kosten, die

durch die Einholung der Sachverständigengutachten entstanden

sind. Diese Kosten trägt der Kläger allein.

Das Urteil ist vorläufig vollstreckbar.

Streitwert: 2.006,- DM, ab 23.06.1986 500,- DM.
