In this first-instance tenancy judgment, the landlord’s claim for the tenant’s consent to a rent increase was granted in part. The defendant was ordered to consent to a monthly base rent of DM 790.57 for the apartment, in addition to the existing operating-cost advance of DM 211.40, effective 1 February 1989. The remainder of the claim was dismissed. Costs were allocated nine-tenths to the plaintiff and one-tenth to the defendant. The judgment was declared provisionally enforceable.

Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 23. April 1990

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, einer Erhöhung der Grundmiete

für die im Erdgeschoß des Hauses Xstraße in X gelegene Wohnung auf 790,57 DM monatlich

zuzüglich der bisherigen Betriebskostenvorauszahlung

von insgesamt 211,40 DM ab 01.02.1989 zuzustimmen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits trägt die Klägerin 9/10, die

Beklagte 1/10.

Das Urteil ist vorläufig vollstreckbar.
