Tenor

hat das Amtsgericht Düsseldorf

ohne mündliche Verhandlung gem. § 495a ZPO am 13.10.1995

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den

Kläger 52,40 DM nebst 12,25 % Zinsen

seit dem 23.11.1994 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreites trägt der

Kläger zu 84 % und die Beklagte zu 16 %.

Das Urteil ist vorläufig vollstreckbar.

Von der Darstellung des Tatbestandes wird gemäß § 495 a ZPO abge-

sehen.
