für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 2.403,40

EUR (= 4.700,65 DM) nebst 5 % Zinsen über dem

Basiszinssatz der Europäischen Zentralbank seit

dem 28.8.2001 zu zahlen

Die Klage im übrigen wird abgewiesen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist gegen Sicherheitsleistung in Höhe von

110 % des beizutreibenden Betrages vorläufig
