The plaintiffs obtained judgment against the defendants concerning a camera or camera dummy installed on the defendants’ double garage and directed toward the plaintiffs’ property and the private path in front of their house. aufgrund der mündlichen Verhandlung vom 12.06.2002

durch den Richter X

für R e c h t erkannt:

Die Beklagten werden verurteilt,

  1. die auf Ihrer Doppelgarage, X- Str. , Y in Richtung auf das Grundstück der Kläger, X- Str. , Y und den Privatweg vor dem Haus gerichtete elektronische Überwachungskamera oder Attrappe zu beseitigen.

  2. die elektronische Überwachung oder nur scheinbare Überwachung durch eine Kameraattrappe des Grundstückes der Kläger, von Teilen des Grundstückes, des Hauses und der Terrasse des Hauses der Klä-ger zu unterlassen, und zwar bei Meidung eines für jeden Fall der Zu-widerhandlung festzusetzenden Ordnungsgeldes bis zu EUR 250.000,00 und für den Fall, dass dieses nicht beigetrieben werden kann, von Ordnungshaft bis zu 6 Monaten.

Die Kosten des Rechtsstreits tragen die Beklagten als Gesamtschuldner.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 2.500,00 EUR.
