für R e c h t erkannt:

Die Klage wird abgewiesen.

Die Kosten des Rechtsstreits werden dem Kläger auferlegt.

Das Urteil ist vorläufig vollstreckbar.

Dem Kläger wird nachgelassen, die Zwangsvollstreckung der Beklagten wegen

der Kosten durch Sicherheitsleistung in Höhe von 110 % des beitreibbaren

Betrages abzuwenden, wenn nicht die Beklagte vor der Vollstreckung Sicherheit

in gleicher Höhe leistet.
