für R e c h t erkannt:

Die Klage wird abgewiesen.

Die Kosten des Rechtsstreits hat der Kläger zu tragen.

Das Urteil ist vorläufig vollstreckbar. Dem Kläger wird nachgelassen, die Zwangsvollstreckung gegen Sicherheitsleistung oder Hinterlegung in Höhe von 110 % des aufgrund dieses Urteils vollstreckbaren Betrages abzuwenden, so-fern nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
