In this first-instance civil judgment, the Düsseldorf Local Court set aside a payment order issued by the Hagen Local Court on 5 March 2004 and dismissed the plaintiff’s claim. hat das Amtsgericht Düsseldorf auf die mündliche Verhandlung vom

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Der Vollstreckungsbescheid des Amtsgericht Hagen vom

5.3.2004 (Az.: 03-2379986-0-0) wird aufgehoben.

Die Klage wird abgewiesen.

Die Kosten des Rechtsstreits werden der Klägerin auferlegt.

Das Urteil ist vorläufig vollstreckbar. Der Klägerin wird

nachgelassen, die Zwangsvollstreckung durch

Sicherheitsleistung in Höhe von 110 % des beizutreibenden

Betrages abzuwenden, wenn nicht die Beklagte vor

der Vollstreckung Sicherheit in gleicher Höhe leistet.
