Basiszinssatz seit dem 28.7.2002 zu zahlen; im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt der Beklagte zu 48 %, die Klägerin zu 52 %.
Das Urteil ist vorläufig vollstreckbar.
