für R e c h t erkannt:

Die Klage wird abgewiesen.

Der Kläger trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar. Der Kläger kann die Vollstreckung

gegen Sicherheitsleistung von 350,00 EUR – auch zu erbringen über

Bürgschaft einer Großbank oder Sparkasse – abwenden, wenn nicht

der Beklagte vor der Vollstreckung Sicherheit in dieser Höhe leistet.
