Following an oral hearing on 6 December 2005, the Düsseldorf Family Court ordered the respondent to pay the applicant a monthly equalization pension of €587.60 from 29 March 2005, payable in advance by the third day of each month. To secure installments falling due after service of the ruling, the respondent must declare assignment to the applicant of an equal monthly portion of his occupational pension claim against O., K.-straße, ##### X. The parties were ordered to share court costs equally, and no extrajudicial costs were awarded.

b e s c h l o s s e n :

Der Antragsgegner wird verurteilt,

  1. der Antragstellerin ab dem 29. März 2005 eine monatliche Ausgleichsrente in

Höhe von 587, 60 € zu entrichten, fällig jeweils monatlich im Voraus bis zum

Monatsdritten;

  1. zur Erfüllung der ab Zustellung dieses Beschlusses gemäß Ziffer 1. fällig

werdenden Rentenansprüche die Abtretung eines Teils seines Anspruchs auf

Betriebsrente gegenüber der Firma O., K.-straße, ‚##### X.,

in Höhe von monatlich 587, 60 €

an die Antragstellerin zu erklären.

Die Gerichtskosten tragen die Parteien je zur Hälfte (§ 93 a ZPO).

Außergerichtliche Kosten werden nicht erstattet (§ 1 a FGG).

Der Geschäftswert beträgt 2.000 € (§ 49 Nr. 3 GKG).
