Resumo Omnilex

The applicants, who live in the second-floor apartment, sought relief concerning impact sound from the parquet flooring in the third participant’s apartment above. The District Court of Düsseldorf partially granted the application, requiring the third participant to take suitable measures so that impact sound transmitted through the flooring in four rooms and the hallway does not exceed 63 dB when measured in the applicants’ apartment. The application was otherwise rejected. The applicants were ordered to bear 65% of the court costs and the third participant 35%; no reimbursement of extrajudicial costs was ordered. The value of the matter was set at €5,000.
