After an oral hearing, the District Court Düsseldorf ordered the defendant to pay the plaintiff €5,000, together with 5% interest from 31 May 2005. Payment is due against transfer of the plaintiff’s rights in the insolvency proceedings concerning DM Beteiligungen AG, arising from a specified €5,000 bearer bond. The court also declared the defendant in default of accepting that counter-performance and allocated the costs of the proceedings to the defendant. The judgment was declared provisionally enforceable.

Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 1. März 2007

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Der Beklagte wird verurteilt, an den Kläger 5000,00 Euro nebst Zinsen in

Höhe von 5 % seit dem 31.05.2005 Zug um Zug gegen Übertagung der

Rechte des Klägers im Insolvenzverfahren über das Vermögen der DM

Beteiligungen AG (Amtsgericht X, Geschäfts-Nr. XXX)

aus der von ihm erworbenen Inhaber-Teilschuldverschreibung der DM

Beteiligungen AG, ISIN: XXX, 1 Stück, Nennbetrag 5000,00

Euro, Nr. XXX zu zahlen.

Es wird festgestellt, dass sich der Beklagte mit der Annahme der Gegen-

leistung gemäß Ziffer 1 im Annahmeverzug befindet.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist vorläufig vollstreckbar.
