Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 24.04.2007

durch den Richter am Amtsgericht X

für Recht erkannt:

  1. Der Beklagte wird verurteilt, an den Kläger 1.843,24 Euro nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 16.11.2006 zu zahlen. Im Übrigen wird die Klage abgewiesen.

  2. Die Kosten des Rechtstreits tragen der Kläger zu 22 % und der Beklagte zu 78 %.

  3. Das Urteil ist für den Beklagten vorläufig vollstreckbar. Der Kläger kann die Vollstreckung durch Sicherheitsleistung oder Hinterlegung in Höhe von 120 % des auf Grund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der Beklagte vor der Vollstreckung Sicherheit in gleicher leistet. Das Urteil ist für den Kläger gegen Sicherheitsleistung in Höhe von 120 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
