The plaintiff brought a civil claim against the defendant concerning €54.63 deposited with Local Court X. Following an oral hearing on 14 August 2007, Düsseldorf Local Court ordered the defendant to consent to release of the deposited sum to the plaintiff and to pay interest at five percentage points above the applicable base rate from 5 July 2002. The remainder of the claim was dismissed. Despite the partial success, the plaintiff was ordered to bear the litigation costs. The judgment was declared provisionally enforceable, subject to the stated security provisions.

Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 14.08.2007

durch die Richterin am Amtsgericht X

für Recht erkannt:

Die Beklagte wird verurteilt, die Freigabe des beim Amtsgericht X

zum Aktenzeichen XXX hinterlegten Betrages in Höhe von 54,63 €

an die Klägerin zu bewilligen.

Die Beklagte wird weiterhin verurteilt, an die Klägerin Zinsen in Höhe von 5

Prozentpunkten über dem jeweils gültigen Basiszinssatz aus 54,63 € seit

dem 05.07.2002 zu zahlen.

Im übrigen wird die Klage abgewiesen.

Die Klägerin trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar. Der jeweilige Vollstreckungsschuldner

darf die Vollstreckung durch Sicherheitsleistung oder Hinterlegung in Höhe

von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht der

jeweilige Vollsteckungsgläubiger vor der Vollstreckung Sicherheit in gleicher

Höhe leistet.
