Following an oral hearing on 11 October 2007, the District Court Düsseldorf ordered the defendant to pay the plaintiff €1,766.36, with interest at five percentage points above the base rate from 14 October 2006. Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 11. Oktober 2007

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Der Beklagte wird verurteilt, an den Kläger 1.766,36 € nebst Zinsen in Höhe von 5-Prozentpunkten über dem Basiszinssatz seit dem 14.10.2006 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits tragen die Parteien je zur Hälfte.

Das Urteil ist für den Kläger gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages vorläufig vollstreckbar.

Der Kläger kann die Zwangsvollstreckung des Beklagten durch Sicherheits-leistung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn dieser nicht in gleicher Höhe Sicherheit leistet.
