Tenor

hat das Amtsgericht Düsseldorf

im schriftlichen Verfahren gemäß § 128 Abs. 2 ZPO

auf der Grundlage der bis zum 19.11.08 eingereichten Schriftsätze der Parteien

durch den Richter am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 1.022,27 Euro nebst Zinsen in Höhe von 8 %-Punkten über dem Basiszinssatz seit dem 22.04.08 zu zahlen.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar.

Die Beklagte darf die Zwangsvollstreckung des Klägers durch Sicherheits-leistung oder Hinterlegung in Höhe von 110 % des zu vollstreckenden Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in entsprechender Höhe leistet.
