The plaintiff sought information concerning specified personal data stored by the defendant, including the data's origin, the recipients or categories of recipients to whom it had been disclosed, and the purpose of storage. Following an oral hearing on 20 November 2008, the Düsseldorf Local Court ordered the defendant to provide that information and to bear the costs of the proceedings. The judgment was declared provisionally enforceable, subject to security of €750.

für Recht er¬kannt:

Die Beklagte wird verurteilt, dem Kläger bezüglich der bei ihr zu ihm gespeicherten Daten – „Dxxx Xxxx“, „Xallee xx“, „XXXXX Xxxxx“, xxx@rechtsanwalt-xxxx.de, „xxxx-xxxxxxx“, „xxxx-xxxxxxx“ – Auskunft zu erteilen, woher diese Daten stammen, an welche Empfänger oder Kategorien von Empfängern diese weitergegeben wurden und zu welchem Zweck die Speicherung erfolgte.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Die Beklagte darf die Vollstreckung durch Sicherheitsleistung in Höhe von 750,00 € abwenden, wenn nicht der Kläger zuvor Sicherheit in gleicher Höhe leistet.
