The plaintiff challenged the association board's decision of 16 July 2008 expelling him from the association and sought payment. Following an oral hearing on 16 December 2008, the Düsseldorf Local Court declared the expulsion decision ineffective. It also ordered the defendant association to pay €316.15, with interest at five percentage points above the base rate from 3 September 2008, and to bear the costs of the proceedings. The judgment was declared provisionally enforceable against security of €4,000.

Tenor

hat das Amtsgericht Düsseldorf auf die mündliche Verhandlung vom 16.12.2008 durch den Richter am Amtsgericht X

für R e c h t erkannt:

Es wird festgestellt, dass der Beschluss des Vorstandes des

beklagten Vereins vom 16.7.2008, mit dem der Kläger aus dem

beklagten Verein ausgeschlossen wurde, unwirksam ist.

Der Beklagte wird verurteilt, an den Kläger 316,15 € nebst 5 %

Zinsen über dem Basiszinssatz seit dem 3.9.2008 zu zahlen.

Die Kosten des Rechtsstreits trägt der Beklagte.

Das Urteil ist gegen Sicherheitsleistung in Höhe von 4.000 €

vorläufig vollstreckbar.

Streitwert: 3.000 €.
