Die Klage wird abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger.

Das Urteil ist vorläufig vollstreckbar.

Der Kläger darf die Kostenvollstreckung der Beklagten durch Sicherheits-

leistung in Höhe von 110 % des beizutreibenden Betrages abwenden, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in gleicher

Höhe leistet.

Die Sicherheitsleistungen können je durch Vorlage einer unbefristeten

selbstschuldnerischen Bürgschaft einer deutschen Bank oder Sparkasse

erbracht werden.
