für Recht erkannt:

Die Beklagte wird verurteilt, an die Klägerin 173,42 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz der EZB seit dem 25.04.2005 sowie vorgerichtliche Anwaltskosten in Höhe von 39,00 € zu zahlen. Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtstreits trägt die Klägerin ¾ und die Beklagte ¼.

Das Urteil ist vorläufig vollstreckbar.
