After an oral hearing on 5 October 2009, the Düsseldorf Local Court ordered the defendant to pay the plaintiff €2,180.60, together with interest at five percentage points above the base rate from 11 December 2008. The defendant was also ordered to bear the litigation costs. The judgment was declared provisionally enforceable against security of 110% of the amount to be enforced; the plaintiff may provide that security by a bank or savings-bank guarantee from an institution based in Germany.

Tenor

hat das Amtsgericht Düsseldorf

auf die mündliche Verhandlung vom 5. Oktober 2009

durch die Richterin am Amtsgericht X

für R e c h t erkannt:

Die Beklagte wird verurteilt, an den Kläger 2.180,60 € nebst Zinsen in Höhe von 5-Prozentpunkten über dem Basiszinssatz seit dem 11.12.2008 zu zahlen.

Die Beklagte trägt die Kosten des Rechtsstreits.

Das Urteil ist vorläufig vollstreckbar gegen Sicherheitsleistung in Höhe von 110 % des zu vollstreckenden Betrages.

Der Kläger darf die Sicherheitsleistung durch Bürgschaft einer Bank oder Sparkasse mit Sitz in der Bundesrepublik Deutschland erbringen.
