In this first-instance civil judgment, Düsseldorf Local Court dismissed the plaintiff’s claim against the defendant. The plaintiff was ordered to bear the costs of the proceedings. Die Klage wird abgewiesen.

Die Kosten des Rechtsstreits trägt der Kläger.

Das Urteil ist hinsichtlich der Kosten vorläufig vollstreckbar.

Der Kläger kann die Zwangsvollstreckung durch Sicherheitsleistung in Höhe von 120 % des vollstreckbaren Betrages abwenden, wenn nicht die Beklagte vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.
