hat das Amtsgericht Düsseldorf

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 01.10.2010

durch den Richter X

für Recht erkannt:

  1. Die Beklagte wird verurteilt, an den Kläger 429,22 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 14.10.2009 zu bezahlen.

  2. Die Beklagte wird verurteilt, an den Kläger vorgerichtliche Rechtsan-waltskosten in Höhe von 43,32 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 14.10.2009 zu zahlen.

  3. Die Beklagte trägt die Kosten des Rechtsstreits.

  4. Das Urteil ist vo¬läufig vollstreckbar.
