Tenor

hat das Amtsgericht Düsseldorf

im vereinfachten Verfahren gemäß § 495a ZPO ohne mündliche Verhandlung am 23.07.2011

durch den Richter X

für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 430,00 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 20.10.2010 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Die Beklagte kann die Vollstreckung durch Sicherheitsleistung in Höhe von 120 % des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht der Kläger vor der Vollstreckung Sicherheit in Höhe von 120 % des jeweils zu vollstreckenden Betrages leistet.

Die Berufung wird zugelassen.
