Tenor
Es wird festgestellt, dass zwischen den Parteien kein Vertragsverhältnis aufgrund des dem Kläger am 27.12.2010 zugesandten Formulars „H-Zentrale“ besteht. Insbesondere wird festgestellt, dass die von der Beklagten mit Rechnung vom 24.01.2011 und 31.01.2012 geltend gemachte Forderung von 702,34 € bzw. 569,06 € nicht bestehen.
Die Beklagte wird verurteilt, die bei ihr vorhandenen Daten des Klägers zu löschen und aus dem Internetverzeichnis h-zentrale.de zu entfernen.
Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits trägt die Beklagte.
Das Urteil ist vorläufig vollstreckbar.
