In this first-instance civil judgment, the District Court of Düsseldorf partially upheld the plaintiff’s claim against the defendant. Tenor

Die Beklagte wird verurteilt, an den Kläger 1.817,22 Euro nebst Zinsen i.H.v. 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 06.12.2012 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Von den Kosten des Rechtsstreits tragen die Beklagte 38 % und der Kläger 62 %.

Das Urteil ist für den Kläger gegen Sicherheitsleistung i.H.v. 120 % des jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.

Für die Beklagte ist das Urteil wegen der Kosten vorläufig vollstreckbar. Der Kläger kann die Vollstreckung der Beklagten abwenden durch Sicherheitsleistung i.H.v. 120 % des gegen ihn vollstreckbaren Betrags, wenn nicht die Beklagte vor der Vollstreckung Sicherheit i.H.v. 120 % des jeweils zu vollstreckenden Betrags leistet.
