Tenor

Die Beklagte wird unter Aufhebung des Versäumnisurteil vom 09.10.2014 verurteilt, an den Kläger 704,05 € nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 06.05.2014 zu zahlen.

Dem Kläger werden die durch seine Säumnis in dem Termin am 09.10.2014 entstandenen Kosten auferlegt. Die übrigen Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar. Die Parteien dürfen die Vollstreckung durch Sicherheitsleistung in Höhe von 110% des jeweils zu vollstreckenden Betrages abwenden, wenn nicht die andere Partei vor der Vollstreckung Sicherheit in gleicher Höhe leistet.
