The Local Court Düsseldorf partially granted the plaintiff’s claims arising from a 20 September 2014 traffic accident involving an Opel Astra. It ordered the defendant to pay EUR 4,335.35 and EUR 492.54, both with interest from 14 July 2015 at five percentage points above the base rate. Tenor

hat das Amtsgericht Düsseldorf auf die mündliche Verhandlung vom 05.02.2016 durch die Richterin am Amtsgericht B

für Recht erkannt:

Die Beklagte wird verurteilt, an den Kläger 4.335,35 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 14.07.2015 sowie 492,54 EUR nebst Zinsen in Höhe von fünf Prozentpunkten über dem Basiszinssatz seit dem 14.07.2015 zu zahlen.

Es wird festgestellt, dass die Beklagte verpflichtet ist, dem Kläger alle weiteren materiellen Schäden aus dem Verkehrsunfall vom 20.09.2014 in Düsseldorf, H-H-Weg, an dem Opel Astra mit dem amtlichen Kennzeichen K zu ersetzen und eine Entschädigung für einen unfallbedingten Nutzungsausfall durch eine weitere Reparatur des Fahrzeuges zu zahlen.

Im Übrigen wird die Klage abgewiesen

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist gegen Sicherheitsleistung Sicherheit in Höhe von 110 % des zu vollstreckenden Betrages vorläufig vollstreckbar.
