Der Beklagte wird verurteilt, an die Klägerin 807,21 EUR nebst Zinsen in Höhe von 5 Prozentpunkten über dem jeweiligen Basiszinssatz seit dem 20.11.2013 sowie vorgerichtliche Mahnkosten in Höhe von 5,00 EUR zu zahlen. Im Übrigen wird die Klage abgewiesen.
Die Kosten des Rechtsstreits tragen die Klägerin zu 17 % und der Beklagte zu 83 %.
Das Urteil ist vorläufig vollstreckbar. Jede Partei kann die Vollstreckung durch Sicherheitsleistung in Höhe von 110 % des aufgrund des Urteils vollstreckbaren Betrages abwenden, wenn nicht die jeweils andere Partei vor der Vollstreckung Sicherheit in Höhe von 110 % des jeweils zu vollstreckenden Betrages leistet.
Die Berufung wird zugelassen.
