The creditor side filed a reminder on 20 July 2017 against a court bailiff's cost calculation dated 27 June 2017, concerning enforcement file DR II 231/17. Düsseldorf Local Court amended the calculation by striking the EUR 8.00 fee under KV 208 and limiting the cost assessment of 23 May 2017 to EUR 86.25. The decision was issued without court fees, and the court found no need for a separate costs order.

Under §§ 5, 7 and 9 GvKostG and the applicable cost schedule, a court hearing a reminder against a bailiff's cost assessment reviews whether the individual fees were lawfully charged. The reminder procedure itself is free of court fees under § 5 Abs. 2 S. 2 GvKostG; a separate costs decision is unnecessary under § 66 Abs. 7 S. 2 GKG.

Tenor

Auf die Erinnerung der Gläubigerseite vom 20.07.2017 wird die Kostenrechnung der/des Gerichtsvollziehers/in G vom 27.06.2017 zum Aktenzeichen DR II 231/17 dahingehend abgeändert, dass der Kostenansatz vom 23.05.2017 unter Streichung der Gebühr KV 208 i.H.v. 8,00 € auf in der Summe 86,25 € beschränkt wird.

Die Entscheidung ergeht gerichtsgebührenfrei; eine Kostenentscheidung ist nicht veranlasst (§§ 5 Abs. 2 S. 2 GvKostG; 66 Abs. 7 S. 2 GKG).
