Tenor

hat das Amtsgericht Düsseldorf

im vereinfachten Verfahren gemäß § 495a ZPO

ohne mündliche Verhandlung am 04.07.2018

durch die Richterin am Amtsgericht E

für Recht erkannt:

Die Beklagte wird verurteilt, an die Klägerin 94,48 EUR nebst Zinsen in Höhe von 5 %-Punkten über dem Basiszinssatz seit dem 06.06.2018 zu zahlen.

Es wird festgestellt, dass das Ereignis vom 18.01.2017, von der Beklagten unter der Schadennummer ##-#####/######-# bearbeitet, nicht zu einer Belastung im Sinne einer Rückstufung der Schadensfreiheitsklasse des Kfz-Haftpflichtversicherungsvertrages, welcher bei der Beklagten unter der Versicherungsscheinnummer ###/######-# angelegt ist, geführt hat.

Die Beklagte wird verurteilt, an die Klägerin vorgerichtliche Rechtsanwaltsgebühren in Höhe von 83,54 EUR nebst Zinsen in Höhe von 5 %-Punkten über dem Basiszinssatz seit dem 06.06.2018 zu zahlen.

Die Kosten des Rechtsstreits trägt die Beklagte.

Das Urteil ist vorläufig vollstreckbar.

Ohne Tatbestand (gemäß § 313a Abs. 1 ZPO).
