The plaintiff brought a civil claim against two defendants. After an oral hearing on 27 June 2018, Düsseldorf Local Court ordered the defendants jointly and severally to pay €3,126. Interest at five percentage points above the applicable base rate was awarded on €2,850 from 24 June 2017 and on a further €276 from different dates for each defendant. The remainder of the claim was dismissed. The defendants were ordered jointly and severally to bear the litigation costs. The judgment was declared provisionally enforceable upon security of 110% of the amount being enforced.

Tenor

für Recht erkannt:

Die Beklagten werden als Gesamtschuldner verurteilt, an die Klägerin einen Betrag in Höhe von 3.126,00 € nebst Zinsen i.H.v. 5 Prozentpunkten über dem jeweils gültigen Basiszinssatz i.H.v. 2.850,00 € seit dem 24.06.2017 und aus weiteren 276,00 € seit dem 14.12.2017 hinsichtlich des Beklagten zu 1 und seit dem 04.05.2018 hinsichtlich des Beklagten zu 2 zu zahlen.

Im Übrigen wird die Klage abgewiesen.

Die Kosten des Rechtsstreits haben die Beklagten als Gesamtschuldner zu tragen.

Das Urteil ist gegen Sicherheitsleistung i.H.v. 110 % des aufgrund des Urteils jeweils zu vollstreckenden Betrages vorläufig vollstreckbar.
