Resumo Omnilex

The Federal Court of Justice's 5th Criminal Senate responded to a reference concerning Section 138 StGB. It held that its own case law did not stand in the way of the intended decision and indicated that it would not adhere to any contrary case law. The Senate agreed in result with the referring Senate that a conviction for failure to report planned offenses may be affirmed even if suspicion of participation in the planned offense persists. It left open whether this is based solely on a normative hierarchy or also on concurrence doctrine.

Sumário Omnilex

Art. 138 Abs. 1 and 2 StGB; failure to report planned offenses despite continued suspicion of participation in the planned offense: a conviction under Section 138 StGB may be affirmed even where suspicion of participation in the planned catalog offense remains unresolved. The Senate held that no existing case law of the Senate precluded this result and stated that it would not adhere to any contrary authority. Whether the solution rests exclusively on a normative hierarchy or also on concurrence considerations was left open (consid. 10 ff. of the referring decision).

Titelzeile
