Tenor

Auf die Revision des Angeklagten wird das Urteil des Landgerichts Berlin vom 4. September 2009 gemäß § 349 Abs. 4 StPO im Ausspruch über die Einziehung von Wertersatz aufgehoben. Die Einziehungsanordnung entfällt.

Die weitergehende Revision wird nach § 349 Abs. 2 StPO als unbegründet verworfen.

Der Beschwerdeführer hat die Kosten des Rechtsmittels zur Hälfte zu tragen. Im Übrigen trägt die Staatskasse die Kosten des Revisionsverfahrens und die Hälfte der dem Angeklagten insoweit entstandenen notwendigen Auslagen.

Gründe

1 Das Landgericht hat den Angeklagten wegen Geldwäsche in drei Fällen zu einer Gesamtfreiheitsstrafe von einem Jahr und sechs Monaten verurteilt, deren Vollstreckung zur Bewährung ausgesetzt wurde. Darüber hinaus hat es angeordnet, dass ein Geldbetrag von 25.000 € als Wertersatz eingezogen wird. Die wirksam auf den Rechtsfolgenausspruch beschränkte Revision des Angeklagten hat lediglich hinsichtlich der angeordneten Einziehung des Wertersatzes Erfolg.

2 Der Generalbundesanwalt hat in seiner Antragsschrift vom 6. April 2010 unter anderem ausgeführt:

3 „Es kann dahingestellt bleiben, ob die Voraussetzungen des § 74a StGB vorliegen. Denn jedenfalls kommt eine Einziehung von Wertersatz gemäß § 74c StGB nicht in Betracht; der Angeklagte war nicht Eigentümer des gemäß § 261 Abs. 7 StGB grundsätzlich der Einziehung als Beziehungsgegenstand unterliegenden Geldes, welches ihm zur Verwahrung übergeben worden war. § 74c StGB setzt indes voraus, dass der Täter oder Teilnehmer zum Zeitpunkt der Tat Eigentümer des der Einziehung unterliegenden Gegenstandes war (vgl. Senat, Beschluss vom 11. Juni 1985 - 5 StR 275/85). Gegenüber tatbeteiligten Nichteigentümern ist die Anordnung von Wertersatzeinziehung hingegen nicht möglich (vgl. LK-Schmidt, StGB, § 74c Rdnr. 17). Eine Anordnung der Einziehung von Wertersatz bei dem Angeklagten scheidet mithin aus.

4 Eine Umdeutung in eine (gewinnabschöpfende) Anordnung von Wertersatzverfall kommt bereits mangels entsprechender Feststellungen nicht in Betracht …

5 Im Übrigen dürften einer Verfallsanordnung die Ersatzansprüche der geschädigten Banken entgegenstehen.“

6 Dem tritt der Senat bei. Er schließt auch aus, dass für eine Verfallsanordnung tragfähige Feststellungen nachholbar wären.
