Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Münster vom 28. März 2013 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels und die den Nebenklägern im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.

Ergänzend bemerkt der Senat:

Soweit das Landgericht - ohne hierzu konkrete Feststellungen getroffen zu haben - einen bevorstehenden Angriff des Geschädigten als möglich in Betracht gezogen hat, scheidet eine Rechtfertigung durch Notwehr (§ 32 StGB) schon deshalb aus, weil der Angeklagte den tödlichen Tritt nicht mit dem erforderlichen Verteidigungswillen geführt hat (vgl. BGH, Urteil vom 25. April 2013 - 4 StR 551/12, NJW 2013, 2133, 2134 f. mwN). Vielmehr ging es ihm darum, eine endgültige Klärung der Auseinandersetzung herbeizuführen und "als eindeutiger Sieger des Zweikampfes aus dieser hervorzugehen" (UA 12).
