Resumo Omnilex

The Federal Court rejected the plaintiff’s complaint against the denial of leave to appeal. It held that damages claims against a tax advisor acting as a fund controller are time-barred under § 68 StBerG a.F., because fund control is a fiduciary activity within § 57(3) no. 3 StBerG and falls within the statute’s scope even if it is not tax advice in VAT terms. The court found the legal issue already settled by prior case law and saw no basis for allowing revision. The plaintiff was ordered to pay the costs.

Sumário Omnilex

§ 68 StBerG a.F.; limitation of claims arising from a fund-control contract concluded by a tax advisor; the three-year limitation applies to Schadensersatzansprüche from all contracts covered by the Tax Consultancy Act, not only to classic tax-advisory services. Mittelverwendungskontrolle is a fiduciary activity within § 57(3) no. 3 StBerG; its non-qualification as tax advice for VAT purposes does not exclude application of § 68 StBerG a.F. Where the legal question is settled by prior Senate case law, there is neither fundamental significance nor a need for clarification or uniformity under § 543(2) ZPO.

In seinem Urteil vom 11.

Halbsatz ZPO abgesehen.

Questão jurídica principal

Whether claims against a tax advisor acting as a fund controller are subject to limitation under § 68 StBerG old version.

Decisão extraída

Yes. Such claims arise from a contract covered by the Tax Consultancy Act and therefore lapse under § 68 StBerG a.F. within three years.

Fundamentação extraída

The Senate relied on its prior case law on claims from a trust agreement and held that fund control is a fiduciary activity under § 57(3) no. 3 StBerG. The fact that, for VAT purposes, the activity is not tax advice does not remove it from the scope of § 68 StBerG a.F., which extends to all contracts covered by the Act.

Questão jurídica principal

Whether the complaint justified admission of revision for reasons of fundamental importance or development/uniformity of the law.

Decisão extraída

No. The matter was already clarified by existing case law, so no reason existed to admit revision.

Fundamentação extraída

The court considered the legal question settled by prior decisions and therefore found neither fundamental importance nor a need for clarification or uniformity through a revisional judgment.
