Strafmilderung bei Beihilfe zur Untreue

Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Bielefeld vom 29. April 2014 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Ergänzend bemerkt der Senat:

Aus der unterlassenen Strafmilderung nach § 28 Abs. 1 i.V.m. § 49 Abs. 1 StGB ergibt sich kein durchgreifender Rechtsfehler. Zwar stellt die nach § 266 Abs. 1 StGB erforderliche Vermögensbetreuungspflicht ein strafbegründendes persönliches Merkmal im Sinne des § 28 Abs. 1 StGB dar (BGH, Beschlüsse vom 12. Juli 1994 - 1 StR 300/94, StV 1995, 73; vom 8. Januar 1975 - 2 StR 567/74, BGHSt 26, 53). Nach der ständigen Rechtsprechung des Bundesgerichtshofs ist eine weitere Milderung neben derjenigen nach § 27 Abs. 2 StGB aber dann nicht geboten, wenn die Verurteilung wegen Beihilfe allein deshalb erfolgt, weil das strafbarkeitsbegründende persönliche Merkmal bei dem Tatbeteiligten nicht vorliegt (vgl. BGH, Beschlüsse vom 6. März 2013 - 5 StR 66/13; vom 22. Januar 2013 - 1 StR 234/12, NJW 2013, 949, Tz. 10; vom 8. Januar 1975 - 2 StR 567/74, BGHSt 26, 53).

Dies ist hier der Fall. Nach den Feststellungen war der Angeklagte an der Firma B. GmbH & Co. KG maßgeblich mit 38 % beteiligt. Die Firma B. T. GmbH betrieb er sogar allein. Er hatte als maßgeblicher Mitgesellschafter bzw. Alleininhaber der Unternehmen und als an der Tatplanung wesentlich Beteiligter Tatherrschaft über das Geschehen und ein erhebliches Eigeninteresse am Zustandekommen der verfahrensgegenständlichen Verträge mit der Firma p. . Die Strafkammer hat den Angeklagten daher ersichtlich nur deshalb (lediglich) wegen Beihilfe verurteilt, weil er gegenüber der Firma p. nicht vermögensbetreuungspflichtig war, so dass die unterlassene weitere Strafmilderung nach § 28 Abs. 1 StGB nicht zu beanstanden ist.
