In a labour law appeal concerning a fixed-term employment dispute, the defendant acknowledged the claim before the Federal Labour Court. Auf die Revision des Klägers wird das Urteil des Landesarbeitsgerichts Berlin-Brandenburg vom 26. September 2008 - 8 Sa 1115/08 - aufgehoben.
Die Berufung der Beklagten gegen das Urteil des Arbeitsgerichts Berlin vom 28. März 2008 - 58 Ca 942/08 - wird zurückgewiesen.
Die Beklagte hat auch die Kosten der Berufung und der Revision zu tragen.

Von der Darstellung des Tatbestandes und der Entscheidungsgründe wird abgesehen (§ 313b Abs. 1 Satz 1 ZPO). Die Beklagte hat den Klageanspruch anerkannt.
