Resumo Omnilex

The employee pursued a declaratory claim against defendant 1 challenging a termination dated 24 December 2009. The Federal Labor Court upheld the revision in part, set aside the Hessian State Labor Court judgment insofar as it had rejected the appeal against defendant 1, and amended the first-instance judgment to declare that the employment relationship was not terminated by that notice. The Court also adjusted the allocation of court and out-of-court costs for all instances, including revision costs against defendant 1. No factual or legal reasoning was provided because the parties waived findings of fact and reasons under § 313a ZPO.

Sumário Omnilex

§ 313a ZPO; waiver of findings of fact and reasons does not preclude appellate review of the operative part; where the revising court amends the lower-court judgment on a declaratory employment claim, it may itself decide the merits and adjust costs accordingly. The operative part is controlling for the extent of the set-aside and amendment; costs are to be allocated by instance and party in accordance with the outcome of the proceedings.

Questão jurídica principal

Whether the employment relationship between the plaintiff and defendant 1 ended by the termination of 2009-12-24.

Decisão extraída

The termination did not dissolve the employment relationship as between the plaintiff and defendant 1.

Fundamentação extraída

The Federal Labor Court set aside the appellate judgment to the extent it had rejected the plaintiff's appeal against defendant 1 and, on appeal, amended the first-instance judgment by granting the declaratory claim.

Questão jurídica principal

Allocation of costs in the first, second, and revision instances.

Costs were allocated partly to the plaintiff and partly to defendant 1; defendant 2 had to bear its own extrajudicial costs, and defendant 1 bore the costs of the revision.
