Tenor

Der Senat tritt der Ansicht des anfragenden 3. Strafsenats bei (vgl. schon Senat, Urteil vom 26. Mai 1976 - 2 StR 634/75, NJW 1976, 1698, 1699). An der unter anderem in den Urteilen vom 1. Februar 1978 - 2 StR 400/77 und 5. Dezember 1990 - 2 StR 287/90 - geäußerten entgegenstehenden Rechtsauffassung wird nicht festgehalten.

Gründe

1 Die vom anfragenden Senat dargelegten Gründe werden in der Literatur allgemein vertreten (vgl. etwa Fischer, StGB, 60. Aufl., § 259 Rn. 21 - 23 mwN). Der Senat tritt ihnen bei. Soweit die Abgrenzung zwischen einer als Erfolgsdelikt verstandenen Tatvariante des Absetzens und der Tatvariante des Einem-Dritten-Verschaffens inmitten steht, wird es Aufgabe der Rechtsprechung sein, klare Abgrenzungskriterien zu entwickeln. Es liegt nahe, die beiden Varianten danach zu differenzieren, in wessen "Lager" der Täter objektiv und subjektiv steht. Aus der Notwendigkeit dieser Differenzierung ergibt sich jedenfalls kein tragfähiger Grund dafür, an der bisherigen Rechtsprechung festzuhalten, die aus den vom vorlegenden Senat zutreffend referierten Gründen durch die gesetzlichen Änderungen der Vergangenheit überholt, mit dem Wortlaut kaum vereinbar und systematisch widersprüchlich ist.
