In this civil non-admission complaint matter, the plaintiff withdrew the action with the defendant's consent. The BGH therefore declared the judgments of the Landgericht Stendal and the Higher Regional Court of Saxony-Anhalt without effect under § 269(3) sentence 1 and § 269(4) ZPO. It also set the value in dispute for the non-admission complaint proceedings at up to EUR 65,000.
