The Federal Constitutional Court refused to admit a constitutional complaint because the filing was not sufficiently substantiated, even taking the late-filed attachments into account. The Court held that the complaint plainly failed to meet the minimum requirements of §§ 23(1) sentence 2 and 92 BVerfGG. Because the filing was manifestly unsubstantial, the Court imposed an abuse fee of EUR 250 under § 34(2) BVerfGG on the complainant’s authorised representatives. The decision is final and not subject to appeal.

Tenor

Die Verfassungsbeschwerde wird nicht zur Entscheidung angenommen.

Den Bevollmächtigten wird eine Missbrauchsgebühr in Höhe von 250 € (in Worten: zweihundertfünfzig Euro) auferlegt.

Gründe

1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen, weil sie mangels hinreichender Begründung unzulässig ist. Das Beschwerdevorbringen genügt selbst unter Berücksichtigung sämtlicher Anlagen - die größtenteils erst nach Fristablauf eingegangen sind - nicht einmal ansatzweise den Mindestanforderungen an eine Substantiierung (§§ 92, 23 Abs. 1 Satz 2 BVerfGG).

2 Die Auferlegung der Missbrauchsgebühr beruht auf § 34 Abs. 2 BVerfGG. Das Bundesverfassungsgericht muss es nicht hinnehmen, an der Erfüllung seiner Aufgaben durch erkennbar substanzlose Verfassungsbeschwerden gehindert zu werden, wodurch anderen Bürgern der ihnen zukommende Grundrechtsschutz nur verzögert gewährt werden kann (vgl. BVerfGK 6, 219; 10, 94 <97>). Den Bevollmächtigten war zuzumuten, vor Einlegung der Verfassungsbeschwerde deren wesentliche Zulassungsvoraussetzungen nach den einschlägigen Vorschriften zur Kenntnis zu nehmen (vgl. BVerfG, Beschluss der 2. Kammer des Zweiten Senats vom 19. März 1998 - 2 BvR 291/98 -, NJW 1998, S. 2205). Hätten sie dies getan, hätten sie erkannt, dass die Verfassungsbeschwerde mangels hinreichender Substantiierung (§ 23 Abs. 1 Satz 2, § 92 BVerfGG) für jedermann ersichtlich unzulässig ist.

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
