Resumo Omnilex

The Federal Constitutional Court did not admit the constitutional complaint. It held that § 2077(1) sentence 1 BGB, which renders testamentary dispositions in favor of a spouse ineffective upon fulfillment of divorce prerequisites, is compatible with Art. 6(1) GG. The Court found no fundamental constitutional significance and no need to enforce the alleged rights under § 93a(2) BVerfGG, and therefore gave no further reasoning under § 93d(1) sentence 3 BVerfGG.

Sumário Omnilex

Art. 6 Abs. 1 GG; § 2077 Abs. 1 Satz 1 BGB; non-admission of a constitutional complaint challenging the premature invalidity of testamentary dispositions in favor of a spouse. The requirement that divorce prerequisites exist and that both spouses have manifested that the marriage is broken down does not infringe the institutional guarantee or the freedom dimension of marriage protection. Where the legislature ties the lapse of a spousal testamentary disposition to the objectively established breakdown of the marriage, it pursues a constitutionally permissible delimitation of the deceased's presumed will and of spousal status; no Art. 6(1) GG violation arises from the mere fact that the disposition becomes ineffective before divorce is formally pronounced (consid. 2).

Titelzeile

Whether the constitutional complaint should be admitted under § 93a(2) BVerfGG.

Decisão extraída

The complaint was not admitted because it raised no general constitutional question and was not necessary to enforce the alleged rights.

Fundamentação extraída

The Court found neither fundamental constitutional significance nor a need for enforcement within the meaning of § 93a(2) BVerfGG.

Questão jurídica principal

Whether § 2077(1) sentence 1 BGB is compatible with Art. 6(1) GG insofar as it causes the premature invalidity of testamentary dispositions in favor of a spouse.

Decisão extraída

The provision does not violate Art. 6(1) GG as an institutional guarantee or as a freedom right.

Fundamentação extraída

The rule presupposes that the conditions for divorce are present and that both spouses have indicated that the marriage has failed and they no longer intend to maintain it; this does not impair marriage protection under Art. 6(1) GG.
